At POKITEREC S.A.S. (hereinafter, "Pokiterec", "we" or "the Company"), Tax ID 1793208451001, with registered office at Av. República del Salvador N34-183 and Suiza, Twin Towers Building, 7th Floor, Quito, Ecuador, we process your personal data in line with Ecuador's Organic Personal Data Protection Law (LOPDP), in force since 2021 and with implementing regulations from 2023.
This document explains what data we collect, why we use it, with whom we share it, and how you can exercise your rights as the data subject. If you still have questions after reading it, write to privacy@pokiterec.com.
1. Data controller
POKITEREC S.A.S., incorporated in Quito in 2024, is the controller of the personal data collected through pokiterec.com. Our Data Protection Officer can be reached at dpo@pokiterec.com.
2. Data we collect
We collect: (a) identification data (names, surnames, national ID or passport) when you fill in the contact form or request access to the platform; (b) contact data (email, phone); (c) browsing data (IP address, device type, pages visited) via cookies and similar technologies; (d) basic financial data only if you choose to register as a lender, subject to a separate explicit consent.
3. Purposes and legal basis
We process your data to: answer queries (basis: pre-contractual measures), send you commercial communications about live projects (basis: consent, which you may revoke at any time), comply with tax and anti-money-laundering duties required by Ecuador's UAFE (basis: legal obligation), and improve our website through aggregate analytics (basis: legitimate interest, balanced against your rights).
4. Retention
We retain your data only for as long as needed for the stated purposes and, afterwards, for the applicable legal limitation periods in Ecuador (up to 10 years for accounting and tax records, under the Tax Code).
5. Recipients and international transfers
We may share your data with: hosting and email technology providers (some based in the United States and the European Union, under standard contractual clauses), notaries and property registries in Ecuador, external auditors, and tax or judicial authorities when the law so requires. International transfers are made with safeguards equivalent to those required by the LOPDP.
6. Your rights
You have the right to access, rectify, erase, object, restrict processing, port your data and revoke your consent. You can exercise them by sending a signed request and a copy of your ID to privacy@pokiterec.com. If you believe we have not handled your request properly, you may file a complaint with Ecuador's Superintendency for Personal Data Protection.
7. Cookies and similar technologies
We use cookies under the Google Consent Mode v2 framework. By default, all marketing and analytics cookies stay denied until you enable them. See our Cookie Policy for details.
8. Changes to this policy
We may update this policy. The current version will be published at pokiterec.com/privacy with its last-updated date. If the changes are material, we will notify you by email when a prior contractual or contact relationship exists.
