These Terms govern access to and use of pokiterec.com (the "Site"), operated by POKITEREC S.A.S., Tax ID 1793208451001, registered office at Av. República del Salvador N34-183 and Suiza, Quito, Ecuador. By using the Site you accept these Terms. If you do not agree, please do not continue browsing.
1. Purpose
The Site is an informational platform presenting the real estate crowdlending services operated by Pokiterec in Ecuador. Any lending transaction is only formalised after prior registration, identity verification and the signing of specific contracts that are not contained on this Site.
2. Capacity and registration
Only individuals over 18 years old with a valid Ecuadorian national ID or passport, or legal entities incorporated under Ecuadorian law, may register as lenders, after completing our due diligence and anti-money-laundering process required by Ecuador's UAFE.
3. Nature of the service
Pokiterec is NOT a financial entity. It does not take deposits from the public and does not manage funds from the public. It acts solely as a technology facilitator connecting private lenders with property developers. Payment flows go through mercantile payment trusts managed by fund administrators regulated by Ecuador's Superintendency of Companies, Securities and Insurance.
4. Risks
Every crowdlending operation carries risk, including: (a) developer default; (b) delays in foreclosing on the mortgage collateral; (c) property value fluctuation; (d) illiquidity (the loans are not tradable on a secondary market). Past returns do not guarantee future returns. The user states being aware of and accepting these risks before lending.
5. Intellectual property
All Site contents (texts, images, brands, code) are owned by Pokiterec S.A.S. or its licensors. Total or partial reproduction without prior written authorisation is prohibited.
6. Limitation of liability
Pokiterec will not be liable for indirect damages, loss of profit or losses arising from the use of the Site. Pokiterec's total liability towards a user, on any ground, will not exceed the fees actually charged to that user in the 12 months prior to the event that led to the claim.
7. Amendments
We may amend these Terms by publishing the new version on the Site with its update date. Continued use of the Site implies acceptance of the changes.
8. Governing law and jurisdiction
These Terms are governed by the laws of the Republic of Ecuador. Any dispute will be resolved by the competent courts of the canton of Quito, unless the law imposes another forum, the parties waiving any other forum or jurisdiction that might correspond to them.
